Is there really such thing as a free lunch?

I was reading some policy terms and conditions today for the RAC "Motor Legal Care" policy - which is the motor legal expenses insurance policy they have recently been giving away free of charge to any RAC breakdown members. A thrilling read I can assure you.

A nice gesture you may feel. Get a legal protection policy for free from one of the big brands. However, on reading the terms and conditions, if you use the policy to claim for personal injury with one of their appointed solicitors, you will lose 25% of your injury compensation to the lawyer! Maybe it is true, maybe there is no such thing as a free lunch?

Reports are being made about the rise of "flash for cash" style claims that are arising. This typically involves somebody waiting to pull out at a junction from a minor road and an approaching car on the main road flashes their lights to gesture the motorist out. The person waiting to pull out pulls out and the other motorist deliberately crashes into them.

In this situation the person pulling out will be found fully at fault for the collision as the other motorist had right of way. In addition, the flashing of headlights is not an actual legitimate way of "giving way" to another motorist as far as the Highway Code is concerned. The flashing of lights is merely to warn other motorists you are there and should not be taken as a signal inviting you to proceed.

More concerning is that these styles of accidents are inherently dangerous for the person pulling out as a side-on impact will most likely arise. It can often be more vulnerable road users who are picked on by criminal gangs and opportunistic individuals such as women with their children in the car or elderly people. Basically people who are more likely to be distracted by the welfare of their children after a collision or not put up much of a protest.

Lee Jones, Managing Director of Free Motor Legal, says that motorists have to be on the lookout for this behaviour. "If you do rely on somebody flashing their lights as a sign they are letting you go, take a moment to observe what they are doing. Are they slowing down and is there plenty of distance between you? Should the worst happen and you are caught in an incident like this, then you need to do your best to get evidence there and then. You need to grab details of any witnesses who may support your story that the other party flashed their lights and then simply drove into you. Call the police if anybody is injured or you suspect a deliberate collision has been caused."

Often the other person will back down if they have been up to no good, but it is important to still get the police on the scene as although they may back down at the scene, there is nothing to stop them still making a claim later on and then it is their word against yours and in this situation they will quite likely win.

The Largest ever repair bill for vehicle repairs in Britain.

A new record has recently been set for the highest cost of repairs to a motor vehicle. Rowan Atkinson of Black Adder fame crashed his McLaren F1 in November 2011.

It was a serious accident which injured the star's shoudler and caused considerable damage to the McLaren after it hit a tree. The engine was found 20 yards away from the vehicle.

The final cost of repairs came to an eye watering £910'000 and it took some time to get the go ahead on the repairs. The cars were originally approx £640k new, but used models have changed hands for as high as £3.5m.

This beats the previous record which was around £300k for repairs to a Pagani Zonda which was paid by Aviva. News of the incident was orignally broadcast on BBC Top Gear when Rowan was interviewed by Jeremy Clarkson.

What is Free Motor Legal?

A fresh and dynamic approach to an often overlooked area of car insurance. Usually people get sold a legal protection policy as a costly add-on when they buy or renew their motor insurance. Typical premiums are £25.00 per annum. But we have seen examples of insurers asking for nearly £40.00 for 12 months cover.

This often means the claim is under-settled and the client gets poor service.

So the customer is sold a policy that actually never gets claimed against or prohibits any borderline claims being considered. Great value for money eh!? But it gets better, not only has your insurer or broker pulled the wool over your eyes by taking money off you for the policy, they then make a killing out of your misery by earning hundreds of pounds in referral fees when they refer you on to solicitors and hire companies etc. Bit of a double-blow for the consumer don’t you think?

In 2012 the Admiral Group of insurers were reported in the press to have taken over £24m of referral fees alone as "ancillary services".

Really speaking, it is not necessary to buy an actual motor legal protection policy, you just need to have somebody in place to take care of matters for you if you do have a collision that was not your fault.
